These Terms govern your use of the Apthar website, including submission of careers applications and business enquiries through our contact form. Apthar LLC is a limited liability company operating in the United States.
1. Acceptance of Terms
By accessing or using the Apthar website at apthar.com ("Site"), submitting a careers application, or sending a business enquiry through our contact form, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use our Site or submit any forms. These Terms apply to all visitors, applicants, and business contacts. If you are accessing this Site on behalf of a company or other legal entity, you represent that you have the authority to bind that entity to these Terms.
2. About Apthar
Apthar LLC is a limited liability company incorporated in the United States, specialising in data engineering, artificial intelligence, cloud architecture, and technology staffing solutions. Our website provides information about our services, insights, career opportunities, and a means to contact us for business enquiries. Nothing on this Site constitutes a binding offer of services unless confirmed in a separate written agreement signed by an authorised representative of Apthar LLC.
3. Careers Applications
3.1 Submission of Applications
- By submitting a careers application, you confirm that all information provided is accurate, complete, and not misleading
- You consent to Apthar LLC collecting, storing, and processing your personal data for recruitment purposes as described in our Privacy Policy
- Submission of an application does not guarantee an interview, offer of employment, or any obligation on Apthar's part
- Apthar LLC reserves the right to reject any application at its sole discretion without providing reasons
- Equal employment opportunity: Apthar LLC is an equal opportunity employer and does not discriminate on the basis of race, color, religion, sex, national origin, age, disability, or any other characteristic protected by applicable federal, state, or local law
3.2 Uploaded Documents
- You are solely responsible for the content of any resume, CV, or documents you upload
- Do not upload documents containing confidential information belonging to third parties or your current employer
- Uploaded files must not contain malware, viruses, or any harmful code
- By uploading documents, you grant Apthar LLC a limited license to store and review them for recruitment purposes only
3.3 Data Retention for Applications
- Application data is retained for up to 12 months unless you consent to longer retention for future opportunities
- You may request deletion of your application data at any time by contacting admin@apthar.com
- California residents have additional rights under the California Consumer Privacy Act (CCPA) — see Section 14
4. Business Enquiries via Contact Form
4.1 Use of Contact Form
- The contact form is intended for genuine business enquiries, partnership discussions, and service-related questions
- You must not use the contact form for unsolicited marketing, spam, or any unlawful purpose
- Apthar LLC will endeavor to respond to enquiries within 2–3 business days but does not guarantee response times
- Submission of an enquiry does not create a client relationship or any contractual obligation
4.2 Confidentiality of Enquiries
- Information submitted via the contact form is not treated as confidential unless a separate non-disclosure agreement is in place
- Do not submit proprietary business information, trade secrets, or sensitive data through the contact form without a signed NDA
- Apthar LLC may use general enquiry information to improve its services and understand market needs
5. Intellectual Property
All content on this Site — including text, graphics, logos, service descriptions, case studies, and insights — is the property of Apthar LLC or its licensors and is protected by United States and international intellectual property laws, including the Copyright Act (17 U.S.C.) and applicable trademark statutes. - Scrape, crawl, or systematically extract data from the Site without written consent
- Impersonate any person or entity, or misrepresent your affiliation with any organization
- Engage in any conduct that could damage, disable, or impair the Site or servers
- Collect or harvest personal information of other users without their consent

APTHAR LLC MAKES NO WARRANTIES OR REPRESENTATIONS, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. While we strive to keep content accurate and up to date, service descriptions, case studies, and insights are illustrative and do not constitute professional, legal, financial, or technical advice. 8. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, APTHAR LLC AND ITS MEMBERS, MANAGERS, OFFICERS, EMPLOYEES, AND CONTRACTORS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THIS SITE, SUBMISSION OF A CAREERS APPLICATION, OR BUSINESS ENQUIRY — INCLUDING BUT NOT LIMITED TO LOSS OF DATA, LOSS OF PROFITS, LOSS OF BUSINESS OPPORTUNITY, OR REPUTATIONAL HARM. OUR TOTAL AGGREGATE LIABILITY FOR ANY CLAIM ARISING FROM USE OF THIS SITE SHALL NOT EXCEED ONE HUNDRED US DOLLARS ($100.00 USD). Some states do not allow the exclusion or limitation of incidental or consequential damages, so the above limitation may not apply to you.

Apthar LLC does not endorse, control, or accept responsibility for the content, privacy practices, or terms of any third-party site. Accessing third-party links is at your own risk.

Your use of this Site and submission of personal data through our forms is governed by our Privacy Policy, which is incorporated into these Terms by reference. By using this Site, you acknowledge that you have read and understood our Privacy Policy. California residents have specific rights under the California Consumer Privacy Act (CCPA) as described in Section 14 below and in our Privacy Policy.
12. Changes to These Terms
Apthar LLC reserves the right to update or modify these Terms at any time without prior notice. Changes will be posted on this page with a revised effective date. Your continued use of the Site after changes are posted constitutes your acceptance of the updated Terms. We recommend reviewing this page periodically. For material changes, we may provide additional notice such as an email notification.
13. Governing Law and Dispute Resolution
These Terms are governed by and construed in accordance with the laws of the United States and the State of Delaware, without regard to its conflict of law principles. Any dispute arising from these Terms or your use of this Site shall first be attempted to be resolved through good-faith negotiation. If unresolved, disputes shall be subject to binding arbitration under the rules of the American Arbitration Association (AAA), conducted in English. Notwithstanding the foregoing, either party may seek injunctive or other equitable relief in any court of competent jurisdiction. You agree to waive any right to a jury trial or to participate in a class action lawsuit.
14. California Residents — CCPA Rights
If you are a California resident, you have specific rights under the California Consumer Privacy Act of 2018 (CCPA), as amended by the California Privacy Rights Act (CPRA):

- Right to Delete — You may request deletion of personal information we have collected from you, subject to certain exceptions

- Right to Limit Use of Sensitive Personal Information — You may direct us to limit our use of sensitive personal information to that which is necessary to perform the services you request
- Right to Non-Discrimination — We will not discriminate against you for exercising any of your CCPA rights
14.2 How to Exercise Your CCPA Rights
- Submit a verifiable consumer request by emailing admin@apthar.com with the subject line "CCPA Request"
- We will respond to your request within 45 days. If we require more time (up to 90 days total), we will inform you of the reason and extension period in writing
- You may designate an authorized agent to make a request on your behalf by providing written authorization
- We may need to verify your identity before processing your request to protect your personal information
